Guardianship & Conservatorship

Guardianship and conservatorship are increasingly necessary for elderly individuals who become incapacitated due to conditions like dementia or stroke. As a relative, typically one of the children, you may need to assume some responsibility for their care, medical decisions, and finances. However, simply informing doctors or banks of your intentions is no longer sufficient.

To properly care for your adult parents, you must be appointed as their guardian and/or conservator by the court. The guardian oversees living arrangements, caregiving, and other personal matters, while the conservator manages their financial affairs.

With the increasing prevalence of autism, it has become crucial for parents to obtain a Guardianship and/or Conservatorship when their child reaches the age of 18. As the child becomes an adult, parents can no longer make decisions on their behalf without this legal arrangement.

The process is similar to that for an incapacitated elderly adult. You will need to petition the court, undergo an investigation by a guardian ad litem, and eventually will be appointed as the guardian.
